AfyaRad Community - Terms and Conditions

These Terms and Conditions ("Terms") govern your use of AfyaRad Community, a free educational platform operated by Africa Afya Healthcare Limited ("Africa Afya," "AfyaRad," "we," "us," or "our"), a company incorporated under the laws of Kenya with its registered office at Karen Flame Business Centre, Dagoretti Road, Nairobi, Kenya.

AfyaRad also operates AfyaRad Marketplace, a separate paid teleradiology service for hospitals and credentialed radiologists. These Terms apply only to AfyaRad Community. If you also use AfyaRad Marketplace, that service is governed by its own agreements, available at africaafya.co.ke/terms-and-conditions.

By creating an AfyaRad Community account, you agree to be bound by these Terms. If you do not agree, do not create an account or use the Services.

1. What AfyaRad Community Is

AfyaRad Community is a free educational platform where members read anonymised, de-identified radiology cases, submit their own written interpretation, and compare it against the original report or finding. Cases are sourced from two places:

• AfyaRad's own network of radiologists, who post cases from their professional experience with all patient identity fully removed before posting
• Properly licensed, already-published academic case reports under permissive open licences (such as Creative Commons Attribution), clearly attributed to their original source on the case page

No case on AfyaRad Community represents a real, current patient awaiting a clinical decision. Every case is retrospective and fully anonymised.

2. Eligibility

You must be at least the age of legal majority in your jurisdiction, or have the consent of a parent or guardian where applicable law permits, to create an AfyaRad Community account. AfyaRad Community is intended for medical students, radiology trainees, practising radiologists, and other healthcare professionals with a genuine interest in radiology education, though we do not require proof of professional status to join.

3. No Clinical Use

AfyaRad Community is an educational tool only. You must not use it to make, support, or inform any actual clinical decision regarding a real patient. Interpretations submitted by members, including the agree, partial, or disagree assessment against the original finding, are for self-assessment and learning only. They are not validated diagnoses.

4. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate information when creating your account and notify us immediately of any unauthorised use. You may delete your account at any time from your settings page or by contacting us.

5. Member Conduct

By using AfyaRad Community, you agree to:

• Submit your own genuine, good-faith interpretation of each case you engage with
• Not share, reproduce, or redistribute case content, images, or other members' interpretations outside the platform without permission
• Not create multiple accounts to circumvent posting limits, cooldowns, or moderation actions
• Engage respectfully with other members; harassment, hate speech, or abusive conduct will result in suspension or termination
• Not attempt to re-identify, or take any action intended to reveal the identity of, any patient associated with a case
• Flag content you believe violates these Terms or raises a safety or anonymisation concern, using the in-platform flagging tool
• Not use automated means (scraping, bots, or similar) to access or extract data from AfyaRad Community without our prior written consent

6. Submitting Your Own Cases

If you are a network radiologist proposing a case for posting on AfyaRad Community, you confirm that:

• You have the right to share the underlying content and that it has been properly de-identified, with no patient-identifying information remaining
• You grant Africa Afya Healthcare Limited a non-exclusive, worldwide, royalty-free licence to host, display, and use the submitted content within AfyaRad Community

Submissions are subject to review, and we may decline or remove any submission at our discretion, including for anonymisation, quality, or licensing concerns. A cooldown period applies between submissions to prevent abuse of the proposal system.

7. Externally Sourced Content

Some cases on AfyaRad Community are sourced from third-party academic publications under open licences such as Creative Commons Attribution. We display attribution to the original source and licence on the relevant case page. We do not claim ownership of externally sourced case content; it remains subject to its original licence terms. We make reasonable efforts to verify the licensing status of such content but do not guarantee the accuracy of third-party licensing claims.

8. Intellectual Property

AfyaRad Community, including its software, design, branding, and the platform's compiled collection of cases, is owned by Africa Afya Healthcare Limited or our licensors. Except as expressly permitted under these Terms, you may not copy, modify, distribute, sell, or lease any part of the Services without our prior written consent.

9. No Fees, For Now

AfyaRad Community is currently provided free of charge. We reserve the right to introduce premium features in the future, which will be clearly identified and subject to separate terms before any payment is required.

10. Disclaimers

AfyaRad Community is provided "as is" and "as available." We make no warranty that the Services will be uninterrupted or error-free. AfyaRad Community does not score, rank, or rate members on whether their interpretation matched the original report. We believe members, including experienced radiologists, should be able to share their honest read without fear of a public "accuracy" score. See our Disclaimer for further detail.

11. Limitation of Liability

To the fullest extent permitted by Kenyan law, Africa Afya Healthcare Limited shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of AfyaRad Community. Because AfyaRad Community is provided free of charge, our total aggregate liability to you under these Terms shall not exceed one hundred United States dollars (USD 100).

12. Suspension and Termination

We may suspend or remove your access to AfyaRad Community at any time for violation of these Terms, including repeated flagging by other members, attempts to circumvent posting cooldowns or multiple-account rules, or conduct that compromises the safety, anonymisation, or integrity of the platform.

13. Professional Network Conversion

Members who consistently demonstrate strong performance on AfyaRad Community may be invited to apply for AfyaRad's professional radiologist network on AfyaRad Marketplace. That network has its own separate, independent credentialing process and agreement. Participation in AfyaRad Community does not itself constitute or guarantee admission to the professional network.

14. Governing Law

These Terms are governed by the laws of Kenya. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.

15. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms on this page with an updated "Last updated" date. Where changes are material, we will take reasonable steps to notify affected members, such as by email or an in-app notice.
